Objectives

a) Identify the nature and function of strategic reasoning, from the example of legal rhetoric;
b) Characterize the ways of \"justification internal\" and \"external\" of legal arguments;
c) To understand the legal rhetoric as a particular case of practical reasoning;
d) Recognize the specificities of the judiciary debate and forensic rhetoric;
e) Identify the modalities of strategic rationality of the individuals that comprise the judiciary debate.

Subject matter

The theme is the strategic argumentation view of the angle of the legal argument.The development of the theory of argumentation has had in view the relation of rhetoric with the theory of communication and decision.From this point of view, the legal discourse represents a \"paradigm case\" of strategic argumentation,persuasion aimed at the listener or an audience.We propose to deepen the understanding of the nature and function of rhetoric, based on the examination of the various plans rationality of legal discourse and, more generally, its characteristics as a model of strategic reasoning.

Teaching method

Given the nature of the studies in presence, we make use of a non-directive approach, encouraging and valuing the debate, active participation in each session. We seek to encourage the participation of students in critical discourse analysis that motivates the decisions of Justice. Theoretical 60%, 40% practical component.

Evaluation method

- Preparation, presentation and class discussion of a research project theoretical / practical on one or more topics and issues raised throughout the course.
- Production and discussion of the final work of the seminar.
