Objectives

This course aims to introduce the students to communication and information law, which is emerging in the information/network society, as well as to legal challenges arising from the current social, economic and political transformations entailed by the computer and Internet revolution, both on substantive law, and on law’s implementation. The focus will be on legal developments in the EU and in Portugal. The Course is divided into two main parts: in the 1st, the focus will be on the relevant rights and freedoms (freedom of expression/information; intellectual property; privacy); in the 2nd, the focus will be on the discussion of modes of regulation of the Internet (public regulation; self-regulation; co-regulation). With a view to encourage the absorption of knowledge by the students, and their capacity for critical analysis, the Course seeks to conciliate a theoretical and a practical perspective to learning, the latter based on the analysis and discussion of case-law.

Subject matter

1. Information society/Network society: a new social paradigm? The law in the information/network society: a new legal paradigm?

2. Communication and Information Law: a domain of law in search for identity.

3. From free speech and freedom of information to private rights on information.

4. The rights to intellectual property in the information and communication society in the EU. The legal protection of software. The legal protection of databases. The protection of copyright in the Internet.

5. The legal protection of personal data in Europe and in Portugal. Freedom and security, two conflicting values in the post- 11 September era.

6. Internet regulation. The regulation of information services. The regime of electronic contracts and electronic commerce. Domain names. The regulation of illicit contents and free speech in the Internet.

7. Internet, political and public participation.

8. The Internet and the judiciary.

Teaching method

Classes are both of a theoretical and of a seminar-like character. Theoretical classes aim to introduce the students to themes and topics od the programme by the professor in charge. Seminars aim to enable the deepening of knowledge on the programme’s subject matters on the basis of case studies, with the active involvement of the students, either through oral presentations or of individual or team work, and the discussion that follows.

Evaluation method

Students’ evaluation will rely on the final examination (50%) and the individual or team work (40%). Attendance and active participation in class will be valued positively in the final marking (10%). The individual/team work will include oral and written assignments: the first one will consist of a presentation in class of the result of the research and analysis of a topic previously selected by the students; the second one will consist of a paper of a maximum of 25 pages.

Courses
