Objectives

During the first half of the semester, familiarize students with the general framework of the obligation and its dogmatic construction, introducing them to the legal instruments at their disposal and developing their skills in the field of legal reasoning and practical problem solving.
Given that the main sources of obligations have been separated from this unit, being the main object of the curricular units of Contract Law and Torts, this curricular unit has as its goal, during the second half of the semester, to ensure that in this important area of the law, students do not leave this Faculty with loopholes in their knowledge. Hence, the sources of obligations not covered by those other units are also an object of study in this unit.

Subject matter

I. Framework. The organization of the common areas of civil law. The academic teaching of the common areas of civil law. The course of “Law of Obligations” within the syllabus of FDUNL.

II. The obligation.

II-A General framework.

1. Introduction. Basic notions. Comparison with other situations. Natural obligations.

2. Fulfilment of the obligation. Concretizations of performance. Effects of fulfilment.

3. Non-fulfilment of the obligation. Problems generated by disturbances within the obligation. Disturbances attributable and not attributable to the obligor.

4. Other causes of extiction of the obligation.

5. Transfer of obligations.

6. Guarantee of obligations. General guarantee. The personal surety.

7. Conclusion.

II-B. Specialties.

1. Plural relations.

2. Other special regimes. Durable obligations, pecuniary obligations, interest obligations, obligations to inform and to submit things.

III: Sources of obligations,

1. The topic of “sources of obligations”.

2. Unjust enrichment.

3. Negotiorum gestio.

4. Open problems.

Teaching method

All the classes are theoretical-practical, and are based on a permanent dialogue between lecturer and students. The various subject matters included in the syllabus are analyzed on the basis of practical exercises which describe life situations, which students are encouraged to prepare at home and solve in class. The resolution of these exercises is commented upon and developed by the lecturer, who complements and develops, whenever necessary, issues of greater complexity, and ensures that the other students follow and understand the presentation. Submittal of a written version of the exercise resolution is stimulated, with the possible development nof some specific related topics.
