Objectives

 1.- Mastery of the criminal procedure legislation in relation to the subject matter of the course and a proper understanding of the essential structure and content of Portuguese criminal procedure.

2.- Comprehension of theoretical and practical problems, namely the permanent tension between the fundamental rights of the defendant, the need of efficiency of criminal justice an the rights of the victims.

3.- After having successfully completed the Criminal Procedure Law I course, students should have acquired the necessary skills in order, in the future, on the one hand to study and understand practical aspects of the work of judges, prosecutors and investigating magistrates and attorneys, in criminal proceedings, and, on the other hand, to continue their studies of Criminal Procedure Law, whether as an optional subject (Criminal Procedure Law II), or as post-graduate studies.

4.- Development of the capacity to analyse, to build solutions and solve problems within the applicable legal framework.

5.- Development of the capacity to make a critical and detailed analysis of legal solutions and courts decisions.

II. The Accusatorial Procedure and the Phases of Criminal Proceedings

III. Sources of Law and fundamental principles of criminal procedure

IV. The Court, the Public Prosecutor, the Accused and his Defense, the Victim and her representation in Court. Civil Liability and Criminal Liability.

V. New Facts and Different Crimes in Trial. The Due Process and Double Jeopardy.

Teaching method

1.Lectures: lectures on the course material by the lecturer; students may pose queries and raise problems.

2.Tutorial: solution of practical cases specifically conceived to promote discussion of various aspects of the course material.

3.Seminar: analysis and consideration of Portuguese case law regarding the topics taught.

4. Evaluation: written examination (3 hours)
