Objectives
To enable students to:
- Understand the fundamental problems of this branch of the law;
- Master the fundamental concepts of this branch of the law;
- Become aware of the main Portuguese rules of this branch of the law;
- Apply the referred rules;
- Become aware of the major aspects of the evolution of this branch of the law in Portugal.
Subject matter
The concept of right in rem (proprietary rights) and its types. Common features and guiding principles of proprietary rights. The right of property (ownership): general questions, questions related to the right of property on land and real estate assets (including the land registry) and questions related to the right of property on moveables assets. Other rights of “use”: usufruct, right of use and habitation, the “surface” rights, “servitudes” and the time-sharing. Rights of “use” abolished. The granting of real securities: the mortgage, the pledge, the pledge of income, the credits privileged by law, the lien, the attachment, the seizure and the right to property by way of security. The acquisition rights: the positions of the beneficiary of a promise to dispose with real effectiveness, of preemption rights with real effectiveness, of the acquirer with real effectiveness, the purchaser subject to reservation of title, the lessee and others. Possession. The Constitution and the law of property.
